The “Communique on the Fee Tariff of the Turkish Patent and Trademark Office to be applied in 2024” finally in effect

The “Communiqué on the Fee Tariff of the Turkish Patent and Trademark Office to be applied in 2024” was published in the Official Gazette No 32526, dated 24 April 2024, and entered into force.

As indicated in our Client Alert in February 2024, the authority to make decisions on revoking trademarks, which was previously held by the Intellectual and Industrial Rights Civil Courts, was transferred to the Turkish Patent and Trademark Office (TURKPATENT) based on Article 26 of the Industrial Property Law No 6769, effective from 10 January 2024. The “Communiqué on the Fee Tariff to be applied in 2023” failed to address the issue of fees for evaluation of revocation requests by TURKPATENT, leading to uncertainty until now. Although TURKPATENT started receiving pre-applications for trademark cancellations as of 10 January 2024, it was unclear how the applicants should be charged for these services. The application fee for trademark revocation, eagerly awaited, has been finally set at 19,560.00 TRY.

Further to this new development and the previously shared regulation draft on the new revocation process, it is anticipated that regulations and guidelines regarding the management of trademark revocation processes will be announced in the near future to resolve any remaining uncertainties. Given these significant changes, it is advisable for trademark owners to closely monitor developments in this area and remain informed about upcoming regulations.
